This might be a little off topic. About 3 weeks ago, I was put on depakote. 100mgs at night. It made my insomnia worse and in the mornings I was a total zombie. My speech was slurred and I was so dizzy that I couldn’t focus my eyes. I had to be at work for 7:30 am and I had to get 3 inches from my computer screen just to read it. I was also having bad digestive issues with the depakote. I worked at a call center and they monitored our calls. They noticed my speech was slurred and sent me back to the temp agency I was employed through to get drug tested. They tested me in their office bathroom.The temp agency told me I tested positive for marijuana and told me I was fired. I asked if any other medication could be mistaken for it because I was having such a bad time on the depakote and they said no and to pack up my stuff. I swore there was no way I could have tested positive for that because I don’t do drugs. They told me my other option was to go to a doctor and get a test done at a medical clinic, which I did and I passed a 10 panel test.  
 
I brought it back to them and they said they would try to get me my job back. I went back to the doctor on 3 days later and he immediately took me off depakote and said that never should have happened and wrote me a note saying I had a bad reaction to a medication he put me on. After I brought them the note saying my slurred speech was from a medication and papers from a HOSPITAL saying I was totally clean, they told me I could not have my job back because I tested positive and treated me like I was a drug addict.
 
I’ve talked to a lawyer, who said I could sue them for disability discrimination and get them for falsifying documents because the hospital says I passed the drug test. Also, the temp agency has no proof I failed a drug test. After the test, they had me flush it and throw the cup out. The lady never showed me the cup to prove I failed it. Honestly, I swear I saw 2 lines, which meant negative. I think she just assumes because my speech was slurred I was on something.
 
I guess my question is, has anyone else had this happen to them while on depakote? The zombie affect with slurred speech? And what would you do? Would you sue? They treated me like shit, but mainly, I want my name cleared

I don’t really know about the slurred speech and the zombification but if I were you I’d sue them to the full extent of your ability. It seems a little unfair to treat someone like that. If the temp agency can not provide evidence that you failed the drug test, and you provided evidence that you passed it clearly you have a case there. I hope you can win.  
 
It just isn’t fair for them to sack you in response to a bad med side effect.
 
I am (almost) sure that marijuana stays in your system for like a month. So shouldn’t the fact that you tested negative the second time constitute for something? Maybe I’m wrong.
